1. SWEEPSTAKES DESCRIPTION

Texas Tech VIP Experience Sweepstakes (the “Sweepstakes”) is sponsored by and promoted by Phillips 66 Company (the “Sponsor“). The Sweepstakes starts at 12:00:00 AM CT on September 16, 2024 and ends at 11:59:59 PM CT on October 27, 2024 (the “Sweepstakes Period”).  All references in these rules are Central Time, which shall control for all purposes of this Sweepstakes.

2. ELIGIBILITY

The Sweepstakes is open to legal United States residents residing in Arkansas, Colorado, Connecticut, Iowa, Idaho, Illinois, Indiana, Kansas, Kentucky, Louisiana, Massachusetts, Maryland, Michigan, Missouri, Mississippi, Montana, North Carolina, North Dakota, Nebraska, New Hampshire, New Mexico, Oklahoma, Pennsylvania, South Dakota, Tennessee, Texas, Utah, Wisconsin, and Wyoming (collectively, the “Territory”) who are at least eighteen (18) years of age and the age of majority in their jurisdiction of primary residence (nineteen (19) in Nebraska, twenty-one (21) in Mississippi and eighteen (18) in all other states) at the time of entry.  Residents of municipalities where registration of this Sweepstakes is required by law, or where this Sweepstakes is prohibited, are not eligible to enter.  Employees, directors and officers of Sponsor, SCAinteractive (“Sweepstakes Administrator”),  their respective parents, subsidiaries and affiliated companies, and Sponsor’s advertising and sweepstakes agencies and each of their respective officers and directors (collectively, with Sponsor, the “Sweepstakes Entities“), and each of their immediate family members and/or those living in the same household of each (whether legally related or not), are ineligible to participate in the Sweepstakes. For purposes of this Sweepstakes, “immediate family members” are defined as spouse, domestic partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren. Sweepstakes is void where prohibited.  Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding on all matters related to the Sweepstakes.

3. HOW TO ENTER

During the Sweepstakes Period, eligible participants may participate by entering through one of the following entry methods (each submission, an “Entry“):

1. In-App during the Sweepstakes Period: Visit a participating Phillips 66® or Conoco® gas station and purchase a minimum of eight (8) gallons of any grade fuel using the Fuel Forward™ App in a single transaction (each a “Qualifying Action“).  If you don’t have the Fuel Forward™ App, you can download it for free from the App store at https://apps.apple.com/us/app/ or Google Play at https://play.google.com/store/apps/. Then, go to the Texas Tech VIP Experience Sweepstakes Deal Card in the Fuel Forward™ App and follow the instructions within the Fuel Forward™ App to enter the Sweepstakes. As part of the entry process, entrants must provide their full name, email address, mailing address, and telephone number. The entrant will need to complete all the fields on the entry page and submit their entry as directed to receive one (1) Entry. Entrants may be given the opportunity to opt-in to receive email communications from Sponsor.  Opting-in will not increase your chances of winning.

2. Entry without purchase: To enter the Sweepstakes without making a purchase or Qualifying Action, there is an alternate method of entry available (the “AMOE”) at https://easyscanamoe.com/easyscan/default/enter?amoe_key=TBD (the “AMOE Website”). At the AMOE Website complete the request form in its entirety with your full name, valid email address, complete postal mailing address (including city, state and zip code, PO Boxes are not allowed), your date of birth and telephone number. Once the request form is completed, follow the instructions to print out the form and affix the bar code accompanying the AMOE entry to a postcard with first class postage affixed and send to: 2024 Texas Tech VIP Experience Sweepstakes, 3030 LBJ Freeway, Suite 300, Dallas TX 75234. All requests must be postmarked between September 16, 2024 and October 27, 2024 and received by October 31, 2024. No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail. Limit one (1) mail-in request per day up to a maximum of forty-two (42) during the Sweepstakes Period.

LIMIT OF ONE (1) ENTRY PER PERSON PER DAY REGARDLESS OF METHOD OF ENTRY.  For purposes of these Official Rules, a ‘day’ is defined as any twenty-four (24) hours during the Sweepstakes Period beginning at 12:00:00 AM CT and ending twenty-four (24) hours later at 11:59:59 PM CT. 

Entries must be received within the Sweepstakes Period to be eligible. Participants must agree to accept and abide by the Official Rules to enter. Online Entrants are subject to all notices posted online including but not limited to the Sponsor’s use and privacy policies. All Entries become the property of the Sponsor and will not be acknowledged or returned. Although subsequent attempts to enter on a given day may be received, only the first complete Entry received from a particular Entrant will be eligible; subsequent attempts by the same person to enter, including Entries submitted with an alternate wireless telephone number or alternate email address are disqualified and void. Any attempt by a person to obtain more than one entry by using multiple or different names or any other methods may void that person’s entry as solely determined by Sponsor. In the event of a dispute as to the identity of the winning entry, the entry will be deemed made by the person who submitted the entry as determined by Sponsor.

4. WINNER SELECTION AND NOTIFICATION:  

On or about October 31, 2024 (the “Drawing Date”), two (2) potential Prize Winners will be randomly selected from all eligible entries received during the Sweepstakes Period by, Sweepstakes Administrator, an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes.  The potential Prize Winners will be contacted at the email address and/or telephone number provided at Entry or at the mailing address provided at Entry, if necessary.  The first attempt to contact potential Prize Winner will be within two (2) days of the Drawing Date. Sponsor is not responsible for false, incorrect, changed, incomplete or illegible contact information. Sponsor shall have no liability for any Prize Winner notification that is lost, intercepted or not received by a potential Prize Winner for any reason. If, despite reasonable efforts, a potential Prize Winner does not respond within two (2) business days of the first notification attempt, or if the Prize or Prize notification is returned as unclaimed or undeliverable to such potential Prize Winner, such potential Prize Winner will forfeit the Prize and an alternate Prize Winner will be selected. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential Prize Winners of a Prize in accordance with the above procedure, after which the Prize in question may go unawarded if it remains unclaimed. If any potential Prize Winner is found to be ineligible, or has not complied with these Official Rules or declines the Prize for any reason prior to award, such potential Prize winner will be disqualified, and an alternate Prize Winner may be selected. Sponsor will have complete discretion over the interpretation of the Official Rules, of administration of the Sweepstakes, and of selection of Prize Winners. Decisions of the Sponsor as to the selection of the Prize Winners will be final.

5. PRIZES/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS:

Two (2) Prizes of a VIP Experience Package for the Texas Tech vs. Baylor game in Lubbock, TX on November 9, 2024 for the winner and up to four (4) guests (each, a “Prize”), are available each consisting of:

• Five (5) game tickets
• Five (5) tickets for VIP Tailgate experience
• On-field experience for five (5)
• One (1) autographed memorabilia item
• One (1) personalized Texas Tech jersey
• One (1) Phillips 66 gas card ($100 value)

The approximate retail value (“ARV“) of each Prize is $965. ARV of all Prizes is $1,930.  Prize Winners are each a “Prize Winner.”   Limit one (1) Prize per person and per household.

The odds of winning a prize will depend on the total number of eligible entries received in accordance with the deadlines stated above. Prize Winners are responsible for all travel costs and expenses, including, without limitation, transportation, lodging, meals, incidentals, gratuities, taxes, and other personal expenses incurred during the use of the prize.

PRIZE WINNER’S GUESTS MUST BE LEGAL U.S. RESIDENTS, 18 YEARS OR OLDER. 

In the event the Prize Winner or Prize Winner’s guest(s) engages in behavior that, as determined by the Sponsor or Promoter, is obnoxious, threatening, illegal, or intended to annoy, abuse, threaten or harass any other person, the Sponsor or Promoter reserve the right to terminate the Prize in whole or in part, with no further compensation. Prize Winner and Prize Winner’s guest(s) agree to comply with all applicable stadium rules and regulations including vaccination or wearing a mask.  If the game is canceled or postponed for any reason, Sponsor will have no obligation to award compensation in lieu of such prize and Sponsor will have no further obligation to the Prize Winner.

Prizes will be fulfilled within a reasonable time after Sponsor’s verification of Prize Winner. All gas cards and tickets are subject to the terms and condition of their issuer. All Prize details and additional terms, conditions, or eligibility requirements are in Sponsor’s discretion. 

6. ALL PRIZES, INCLUDING GAME TICKETS, ARE NON-TRANSFERABLE AND FOR PERSONAL, NON-COMMERCIAL USE ONLY.

Prize Winners are responsible for the reporting and payment of all federal, state and local taxes (if any) and any other costs and expenses associated with Prize acceptance and use not specified in these Official Rules and/or in the applicable entry instructions as being provided.  Winner will be issued a 1099 tax form for any Prize received valued at $600 or more following receipt of the Prize.  Once awarded, Prize may not be resold or commercially traded in any manner, directly or indirectly.  Prize not claimed in accordance with these Official Rules will not be awarded. All details and other restrictions of Prize not specified in these Official Rules will be determined by Sponsor in its sole discretion. 

7. CONDITIONS OF PARTICIPATION:

Participants agree (a) to abide by these Official Rules and the decisions of Sponsor which are final and binding, (b) that the Sweepstakes Entities will have no liability whatsoever for, are released and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes or Sweepstakes-related activities, including any travel related thereto, and (c) except where legally prohibited, Prize Winners grant (and agree to confirm that grant in writing) permission to Sponsor and those acting under Sponsor’s authority the right to the use of their name, photograph, likeness, voice, image and biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval.

8. GENERAL PRIZE CONDITIONS

Prize Winners assume all risk and liability for any injury or damage caused or claimed to be caused by or to Prize Winner, by or to Prize Winner’s guest(s), if applicable, or the use/misuse or redemption of any Prize by Prize Winner or Prize Winner’s guest(s).

By accepting a Prize, Prize Winners agree to release the Sponsor and Promoter from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Promotion or for damages of any kind caused by any Prize or resulting from acceptance, possession, or use/misuse of any Prize awarded.

All federal, state and local laws and regulations apply. By participating in this Promotion, you agree to be bound by the Official Rules, along with Sponsor’s Terms and Conditions and Privacy Statement. Material submitted becomes the sole property of Sponsor and will not be returned. Sponsor shall also have the right to take such other measures as it deems necessary in its sole discretion to preserve the integrity of this Promotion. Sponsor is not responsible for (a) lost, late, mutilated, illegible, misdirected, incomplete, or non-delivered mail, posts, text messages or email, or for interrupted or unavailable satellite, network, server, internet service provider, website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed or misdirected transmissions or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information; and (b) any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Promotion, any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the website, and (c) any other unforeseeable events. Sponsor reserves the right, at its sole discretion, to (1) disqualify any individual, who tampers with the entry process or operation of the Promotion, and (2) modify, suspend or terminate all or part of this Promotion. Notice of such modification, termination or suspension will be posted on the Promotion entry page, if any, and/or on Sponsor’s primary website.

9. LIMITATION OF LIABILITY:

You agree to release and hold harmless Sponsor, Sweepstakes Administrator, and their respective parents, affiliates, subsidiaries, retailers, marketers, dealers, advertising agencies, web designers, promotion agencies and prize suppliers, and each of their respective officers, directors, shareholders, employees, agents, successors and assigns (collectively, the “Released Parties”) from any and all liabilities, damages, losses, injuries, claims and actions of any kind arising out of or resulting from participation in this Promotion or from the acceptance, use or misuse of any prize or other such benefit including, without limitation, claims based on death, publicity rights, defamation or invasion of privacy. Released Parties are not responsible for any error or malfunction that occurs during the Promotion, in the announcement of the prizes, in awarding of more prizes than are intended, or in any promotion-related materials. The Released Parties (i) make no warranty, guaranty or representation of any kind concerning the prizes and (ii) disclaim any implied warranty.

10. YOUR PERSONAL INFORMATION, PRIVACY STATEMENT AND TERMS OF USE:

By participating in this Promotion, you hereby agree to Sponsor’s collection and usage of your personal information to (1) contact you by mobile phone, e-mail, or regular mail for the administration of this Promotion, (2) allow Sponsor or its select parties to contact you for promotional purposes should you opt-in as outlined in section 1, and (3) better understand the entrants and help Sponsor tailor its communications to you and other entrants. You also hereby agree to Sponsor’s collection and usage of your personal information to contact you by any method made available by you to Sponsor, including regular mail (if applicable), for the administration of this Promotion and prize fulfillment. You acknowledge that you have read and accepted Sponsor’s privacy statement and terms of use. Sponsor will not use or disclose your personal information for any other purpose other than what is stated in these Promotion rules and Sponsor’s privacy statement without your consent. IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS PROMOTION OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES. By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Promotion or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize(s). 13. NOTICE TO ENTRANTS:

In the event of a dispute over the identity of an Entrant, entry will be deemed submitted by the “Authorized Account Holder” of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any Entrant or potential Prize Winner to provide Sponsor with proof that such party is the authorized account holder associated with the entry to Sponsor’s satisfaction. By participating in the Promotion, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent Promotion Administrator, which are final and binding in all matters relating to the Promotion. Failure to comply with these Official Rules may result in disqualification from the Promotion. Sponsor reserves the right to: (i) permanently disqualify from any Promotion it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Promotion), and to select Prize Winners from among all eligible entries received prior to withdrawal.

14. LEGAL WARNING:

15. DISPUTES AND GOVERNING LAW:

Except where prohibited, you agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Texas, without giving effect to any choice of law or conflict of law rules (whether of the state of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Texas.

All such requests must be received within six (6) weeks after the end of the Sweepstakes Period.
