1. GIVEAWAY DESCRIPTION

The Denver Broncos Tickets and Fuel Card Giveaway (the “Giveaway”) is sponsored by and promoted by Phillips 66 Company (collectively, the “Sponsor“). The Giveaway starts at 12:00:00 AM on July 29, 2024 and closes at 11:59:59 PM on December 29, 2024 (the “Giveaway Period”).  All references in these rules are Mountain Time, which shall control for all purposes of this Giveaway.

2. ELIGIBILITY

The Giveaway is open to legal residents of Colorado who are eighteen (18) years of age or older.  Residents of municipalities where registration of this Giveaway is required by law, or where this Giveaway is prohibited, are not eligible to enter.  Employees of the Sponsor, the NFL Entities (as defined below), and each of their respective parent, subsidiary, and affiliated companies (collectively “Giveaway Parties”) and the officers, directors and employees of each of these entities and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and household members, whether or not related, of each of these people are not eligible to participate.  Giveaway is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding on all matters related to the Giveaway.

3. HOW TO ENTER

During the Giveaway Period, eligible participants may participate by entering through one of the following entry methods (each submission, an “Entry”):

1. In-App during the Giveaway Period: By visiting a participating Phillips 66® or Conoco® gas station and purchasing a minimum of eight (8) gallons of any grade fuel using the Fuel Forward™ App in a single transaction (each a “Qualifying Action”) during the Giveaway Period.  If you don’t have the Fuel Forward™ App, you can download it for free from the App store at https://apps.apple.com/us/app/ or Google Play at https://play.google.com/store/apps/. Go to the Denver Broncos and Fuel Card Giveaway Deal Card in the Fuel Forward™ App and follow instructions on the Website within the Fuel Forward™ App. Participants must provide their full name, email address, mailing address, and telephone number. The participant will need to complete all the fields on the entry page to receive an Entry. Entrants may be given the opportunity to opt-in to receive email communications from Sponsor.

2. Entry without purchase: To enter the Giveaway without making a purchase or Qualifying Action, there is an alternate method of entry available (the “AMOE”) at https://easyscanamoe.com/easyscan/default/enter?amoe_key=kzaimm8bwj (the “AMOE Website”) and complete the request form in its entirety with your full name, valid email address, complete postal mailing address (including city, state and zip code), your date of birth and telephone number. Once the request form is completed, follow the instructions to print out the form and affix the bar code accompanying the AMOE entry to a post card with first class postage to: The 2024 Denver Broncos Tickets and Fuel Card Giveaway, 3030 LBJ Freeway, Suite 300, Dallas TX 75234. All requests must be postmarked and received by the dates outlined in the chart in the section below. All requests must be postmarked between July 29, 2024, and December 23, 2024, and received by December 29, 2024. No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail. Limit one (1) mail-in request per Day to a maximum of one-hundred forty-seven (147) during the Giveaway Period. PO Boxes are not allowed.

Entries must be received within the Giveaway Period to be eligible. Participants must agree to accept and abide by the Official Rules to enter. Online Entrants are subject to all notices posted online including but not limited to the Sponsor’s use and privacy policies. All Entries become the property of the Sponsor and will not be acknowledged or returned. Although subsequent attempts to enter on a given day may be received, only the first complete Entry received from a particular Entrant will be eligible; subsequent attempts by the same person to enter, including Entries submitted with an alternate wireless telephone number or alternate email address are disqualified and void.   

Prizes will be fulfilled within a reasonable time after Sponsor’s verification of Prize Winner. All gas cards and tickets are subject to the terms and condition of their issuer. All prize details and additional terms, conditions, or eligibility requirements are in Sponsor’s discretion.

5. LIMITATIONS

Limit one (1) pair of 2024/2025 Denver Broncos tickets per person or address. Limit two (2) $10.00 Phillips 66® or Conoco® gas cards per person. Any attempt by a person to obtain more than one entry by using multiple or different names or any other methods may void that person’s entry as solely determined by Sponsor. In the event of a dispute as to the identity of the winning entry, the entry will be deemed made by the person who submitted the entry as determined by Sponsor.

6. ALL PRIZES, INCLUDING GAME TICKETS, ARE NON-TRANSFERABLE AND FOR PERSONAL, NON-COMMERCIAL USE ONLY.

No substitution or transfer of prizes or cash redemption is permitted. Sponsor reserves the right to substitute a prize (or portion thereof) of comparable or greater value, in its sole discretion. Prize Winners are responsible for the reporting and payment of all federal, state and local taxes (if any) and any other costs and expenses associated with prize acceptance and use not specified in these Official Rules and/or in the applicable entry instructions as being provided.

7. PRIZES/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS:

FIRST PRIZES: Ten (10) first prize winners (each, a “First Prize Winner”) will receive two (2) tickets to a dated Denver Broncos game as defined in section 4 (each, a “First Prize”). Approximate Retail Value (“ARV”) of each First Prize is $132.

SECOND PRIZES: Fifty (50) winners will be randomly selected for each of the 10 Prize Periods (each, a ” Second Prize Winner”) to receive a $10.00 Phillips 66® or Conoco® gas card (each, a ” Second Prize”). (May be physical or digital at Phillips 66’s sole discretion.)  Approximate Retail Value (“ARV”) of each Second Prize is $10.

ARV of all First Prizes and Second Prizes (each, a “Prize”) is $18,200.00 in total.  First Prize Winners and Second Prize Winners are each a “Prize Winner”.

Odds of winning will depend upon the total number of eligible Entries received. Prize Winners are responsible for all travel costs and expenses, including, without limitation, transportation, lodging, meals, incidentals, gratuities, taxes, and other personal expenses incurred during the use of the prize. If a Denver Broncos Game is canceled or postponed for any reason, Sponsor will have no obligation to award compensation in lieu of such prize and Sponsor will have no further obligation to the Prize Winner.

8. RANDOM DRAWINGS

Prize Winners will be selected in a random drawing on or about the dates listed in the chart above, respectively, from among all eligible Entries received by the Giveaway Administrator, an independent agent of the Sponsor whose decisions are final. Limit one (1) First Prize per person or address during the Giveaway Period. Limit one (1) Second Prize per person per Home Game Prize Period and a limit of two (2) Second Prize per person during the Giveaway Period. The Prize Winners will be contacted at the email address and/or telephone number provided at Entry or at the mailing address provided at Entry, if necessary.

All drawings will be conducted by the Giveaway Administrator, an independent judging organization, whose decisions are final and binding in all matters relating to this Giveaway.

Sixty (60) potential winners will be selected at random each “Drawing Date” of the Giveaway Period (per Section 4), before the Denver Broncos have a home game. Broncos tickets prizes will be emailed to the First Prize Winners. Phillips 66® or Conoco® $10.00 digital gas card prizes will be input into the corresponding Second Prize Winner’s account within the Fuel Forward™ App. Digital or physical gas card is at the sole discretion of the Sponsor. Should a physical card be mailed to Second Prize Winners, incomplete and/or inaccurate addresses are void – including but not limited to P.O. Box addresses. Limit one (1) pair of Denver Broncos tickets per person or address. Limit two (2) $10.00 Phillips 66® or Conoco® gas cards per person. Sponsor’s determination of ineligibility or noncompliance with these Official Rules will result in disqualification of the entry. If a potential winner’s entry is disqualified, an alternate winner will be selected.

9. CONDITIONS OF PARTICIPATION

Participants agree (a) to abide by these Official Rules and the decisions of Sponsor which are final and binding, (b) that the Giveaway Parties will have no liability whatsoever for, are released and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Giveaway or Giveaway-related activities, including any travel related thereto, and (c) except where legally prohibited, Prize Winners grant (and agree to confirm that grant in writing) permission to Sponsor, the Giveaway Parties and those acting under Sponsor’s authority the right to the use of his/her name, photograph, likeness, voice, image and biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval.

10. GENERAL PRIZE CONDITIONS

Prize Winners assume all risk and liability for any injury or damage caused or claimed to be caused by or to Prize Winner, by or to Prize Winner’s guest, if applicable, or the use/misuse or redemption of any Prize by Prize Winner or Prize Winner’s guest. In the event, an electronic gas card cannot be sent via the Fuel Forward™ App, a physical gas card will be sent via mailing address provided at entry.

By accepting a Prize, Prize Winners agree to release the Sponsor and Promoter (collectively, the “Released Parties”) from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Promotion or for damages of any kind caused by any Prize or resulting from acceptance, possession, or use/misuse of any Prize awarded.

All federal, state and local laws and regulations apply. All federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the Prize Winner. No cash equivalent, transfer or substitution of any prize is permitted except at Sponsor’s sole discretion. Prize acceptance constitutes permission to Sponsor, and their agencies and participating retailers to use the recipient’s name and/or likeness for advertising or trade without further compensation in perpetuity, unless prohibited by law. By participating in this Promotion, you agree to be bound by the Official Rules, Terms and Conditions, and Privacy Statement. Material submitted becomes the sole property of Sponsor and will not be returned. Released Parties shall also have the right to take such other measures as it deems necessary in its sole discretion to preserve the integrity of this Promotion. Released Parties are not responsible for (a) lost, late, mutilated, illegible, misdirected, incomplete, or non-delivered mail, posts, text messages or email, or for interrupted or unavailable satellite, network, server, internet service provider, website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed or misdirected transmissions or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information; and (b) any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Promotion, any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the website, and (c) any other unforeseeable events. Released Parties are not responsible for injury or damage to a participant’s or any other person’s mobile phone, computer, tablet or any other entry device related to or resulting from participating in this Promotion.

11. LIMITATION OF LIABILITY

You agree to release and hold harmless Sponsor, Promoter, Facebook, Twitter, Instagram, the National Football League and its member clubs, and their respective parents, affiliates, subsidiaries, retailers, marketers, dealers, advertising agencies, web designers, promotion agencies and prize suppliers, and each of their respective officers, directors, shareholders, employees, agents, successors and assigns (collectively, the “Released Parties”) from any and all liabilities, damages, losses, injuries, claims and actions of any kind arising out of or resulting from participation in this Promotion or from the acceptance, use or misuse of any prize or other such benefit including, without limitation, claims based on death, publicity rights, defamation or invasion of privacy. Released Parties are not responsible for incomplete, misdirected, delayed, undelivered, inaccurate, lost, late, garbled, mutilated, illegible entries, postage-due mail, incorrect or inaccurate transcription of entry, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials, technical, network, telephone equipment, electronic, computer, hardware or software malfunctions, or limitations of any kind or for entries that for any reason are not received by Sponsor by the stated deadline. Released Parties are not responsible for any error or malfunction that occurs during the Promotion, in the announcement of the prizes, in awarding of more prizes than are intended, or in any promotion-related materials. The Released Parties (i) make no warranty, guaranty or representation of any kind concerning the prizes and (ii) disclaim any implied warranty.

12. YOUR PERSONAL INFORMATION, PRIVACY STATEMENT AND TERMS OF USE

By participating in this Promotion, you hereby agree to Sponsor’s collection and usage of your personal information to (1) contact you by mobile phone, e-mail, or regular mail for the administration of this Promotion, (2) allow Sponsor or its select parties to contact you for promotional purposes should you opt-in as outlined in section 1, and (3) better understand the entrants and help Sponsor tailor its communications to you and other entrants. You also hereby agree to Sponsor’s collection and usage of your personal information to contact you by any method made available by you to Sponsor, including regular mail (if applicable), for the administration of this Promotion and prize fulfillment. You acknowledge that you have read and accepted Sponsor’s privacy statement and terms of use. Sponsor will not use or disclose your personal information for any other purpose other than what is stated in these Promotion rules and Sponsor’s privacy statement without your consent. 13. FIRST PRIZE CONDITIONS

No substitution or transfer of Prize or election of cash in lieu of Prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute any Prizes with another Prize of equal or greater value in the event that the Prize (or any component thereof) is not available. If any potential First Prize Winner fails to respond to the Sponsor’s and/or Promotion Administrator’s email notification within three (3) days of the initial contact by the Sponsor or Promotion Administrator, then such person shall be disqualified, and an alternate Prize Winner may be awarded the applicable Prize. Further, if a Prize or Prize notification is returned as undeliverable, or if Prize Winner is found to be ineligible or not in compliance with these Official Rules, such Prize Winner will be disqualified, and the Prize may be awarded to an alternate Prize Winner in a separate random drawing.

FIRST PRIZE WINNER’S GUEST MUST BE A LEGAL U.S. RESIDENT, 18 YEARS OR OLDER. 

All travel and other expenses related to the acceptance or use of the Prize are the sole responsibility of Prize Winner.

In the event the Prize Winner or Prize Winner’s guest engages in behavior that, as determined by the Sponsor or Promoter, is obnoxious, threatening, illegal, or intended to annoy, abuse, threaten or harass any other person, the Sponsor or Promoter reserve the right to terminate the Prize in whole or in part, with no further compensation. Prize Winner and Prize Winner’s guest agree to comply with all applicable stadium rules and regulations including vaccination or wearing a mask.

Prizes are not redeemable for cash. Prizes are non-assignable or transferable. No substitution is permitted except if Prize is unavailable, in which case a Prize of equal or greater value will be awarded. No cash in lieu of Prizes or any exchange or substitution of Prizes, except at the sole discretion of the Sponsor. Prizes will not be replaced if lost or stolen. Gift cards and vouchers, if applicable, are subject to the issuing company’s complete terms and conditions, including expiration dates.

Any other incidental expenses on Prize not specified herein are the Prize Winner’s sole responsibility.

Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Prize Winners acknowledge that Sponsor and all other businesses affiliated with this Promotion and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the Prize being offered, except that each merchandise Prize shall be subject to its manufacturer’s standard warranty (if any).

Tickets are not redeemable for cash and will not be replaced if lost or stolen. Tickets are subject to the issuing company’s complete terms and conditions. In the event that the scheduled game does not take place as scheduled, for reasons such as cancellation, preemption or postponement, or for any reason beyond the control of the Sponsor, no additional substitution or compensation will be provided.

Except where prohibited by law, entry and acceptance of Prize constitute permission to use Prize Winner’s name, Prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

14. GENERAL

By accepting a Prize, where permitted by law, Prize Winner or recipient grants to the Sponsor, including its parent, subsidiaries and related companies, and those acting pursuant to the authority of Sponsor, the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the recipient’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL SPONSOR, PROMOTER AND PROMOTION ADMINISTRATOR (COLLECTIVELY, “RELEASED PARTIES”) BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS PROMOTION OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES. By participating in the Promotion, Entrants hereby agree to Sponsor’s and Promoter’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

16. NOTICE TO ENTRANTS

In the event of a dispute over the identity of an Entrant, entry will be deemed submitted by the “Authorized Account Holder” of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any Entrant or potential Prize Winner to provide Sponsor with proof that such party is the authorized account holder associated with the entry to Sponsor’s satisfaction. By participating in the Promotion, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent Promotion Administrator, which are final and binding in all matters relating to the Promotion. Failure to comply with these Official Rules may result in disqualification from the Promotion. Sponsor reserves the right to: (i) permanently disqualify from any Promotion it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Promotion), and to select Prize Winners from among all eligible entries received prior to withdrawal.

17. LEGAL WARNING

ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE WEBSITE OR INTERFERE WITH THE OPERATION OF THE PROMOTION, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

18. DISPUTES AND GOVERNING LAW

Except where prohibited, you agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Giveaway, shall be governed by, and construed in accordance with, the laws of the state of Texas, without giving effect to any choice of law or conflict of law rules (whether of the state of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Texas.

19. PRIZE WINNERS LIST

For the names of the winner(s) of the First Prize Winner(s), send a self-addressed, first-class stamped business sized envelope to: 2024 Denver Broncos Tickets Giveaway Winners List, 3030 LBJ Freeway, Ste. 300, Dallas, TX 75234. Requests must be received by December 31, 2024.
